1. Introduction
Welcome to EchoMCQ.com. EchoMCQ is an online revision resource for the use of qualified health professionals and medical students preparing for examinations in echocardiography, including (but not limited to) the British Society of Echocardiography (BSE) and EACVI Transthoracic written examinations.
Use of this website is conditional on accepting these Terms and Conditions. Please read them in full before using the service. By registering for an account, subscribing, or otherwise using the website, you indicate that you accept these Terms and Conditions and agree to abide by them. If you do not agree to be bound by these terms, do not use the website.
These Terms and Conditions apply to the use of the services provided by Sycamore Healthworks Ltd (registered office below). They may change over time. Those applicable to subscribers are the terms current and agreed to when the subscriber starts their subscription.
The website and the subscription process are in English only. If you have any questions about these terms, please contact us at support@echomcq.com.
2. Subscription, free trial and pricing
EchoMCQ is offered as a monthly subscription. The current price is shown on the website at the point of purchase. Payments are taken in pounds sterling (GBP). If you pay from a non-GBP account, your card provider will determine the exchange rate of the transaction.
New subscribers may be offered a free trial period (currently 24 hours). At the end of the trial period, your subscription will automatically convert into a paid subscription unless you cancel before the trial ends. Auto-renewal will continue at the displayed monthly price until you cancel. You will be reminded of your right to cancel before the trial ends and of any subsequent renewals in accordance with the Digital Markets, Competition and Consumers Act 2024 (DMCC).
You undertake that all the details you give us when subscribing are correct, that the payment card you use is your own (or that you are authorised to use it), and that there are sufficient funds to cover the cost of the subscription.
3. Your right to cancel (UK consumers)
If you are a consumer based in the United Kingdom, you have the following statutory rights, which these Terms and Conditions do not affect or remove:
- 14-day cooling-off period for digital content (Consumer Rights Act 2015, s.42, and the Consumer Contracts Regulations 2013): you may cancel your subscription within 14 days of starting it for any reason. However, by starting your free trial or accessing the question bank within the 14-day period, you expressly request that the service begins immediately, and you acknowledge that doing so reduces or removes your statutory right to a refund for content already supplied. You will not be charged for content you have not yet accessed.
- Cancellation of an ongoing subscription: you may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period; you retain access until that date. We do not pro-rate refunds for a partially used billing period unless the service has been materially defective.
- Refunds for defective digital content (Consumer Rights Act 2015, ss.34–46): if the service does not meet the statutory standards of satisfactory quality, fitness for purpose, and matching its description, you are entitled to a repair, replacement, price reduction, or refund as appropriate.
To cancel a subscription, manage your billing in your Stripe customer portal (linked from your account page), or email support@echomcq.com. Cancellation requests are processed within two working days.
4. Use of the website
Accounts are personal to the subscriber and are for that subscriber's sole and personal revision. Passwords and other log-in details must not be shared with or passed to others. We reserve the right to take action if this requirement is not adhered to, including but not limited to immediate termination of your subscription without refund.
If you use or attempt to use the service for purposes other than personal individual revision, including but not limited to copying, redistributing, or reselling questions, answers, or explanations, or attempt to tamper with, hack, modify, or otherwise corrupt the security or functionality of the service, your account will be terminated and you may be subject to damages and other penalties, including criminal prosecution where applicable.
While we will endeavour to ensure that the website remains continuously available, access may be restricted from time to time for site maintenance, upgrades, or due to technical problems. We cannot accept responsibility for any loss or damage that may result from temporary unavailability. If the website is materially inaccessible for a substantial period during an active subscription, we will, on request, extend the affected subscription by the time the website was unavailable.
The website is optimised for use on a modern desktop or mobile browser. Use of older or non-standard browsers may result in restricted functionality.
5. External links
For the convenience of subscribers the EchoMCQ website contains links to external sites (including video clip hosts and reference resources). The inclusion of a link does not imply endorsement or approval of the linked site or its contents, which is independent of Sycamore Healthworks Ltd and over which we have no control. We can accept no responsibility for the contents of external sites or for any loss or damage that may result from using them.
6. Intellectual property and copyright
The EchoMCQ website is protected by copyright. Its content, design, layout, databases, and graphics shall not be reproduced, stored, or transmitted in any form or by any means, including but not limited to electronic, paper, mechanical, photocopying, recording, or broadcasting; nor shall the content be shown in a public gathering. You may only use the material available for your own personal, non-commercial revision, provided that it is not changed and copyright notices remain intact. Sycamore Healthworks Ltd retains the intellectual property rights in all material from this website. You shall not create any derivative work or make any other adaptation without our prior written consent.
Where the website hosts third-party clinical video clips or images under licence, those clips remain the property of their respective owners and are used here for educational purposes only.
All rights not explicitly granted in these Terms and Conditions or in any written licence remain reserved.
7. Educational scope and clinical disclaimer
EchoMCQ is a revision resource for examination preparation. It is not a substitute for clinical judgement, current published guidelines, your local protocols, or appropriate senior review. Always cross-refer to a recognised current source (for example the British National Formulary for drug dosing, the relevant ESC or BSE guideline for diagnosis and management) before applying any content from this website to patient care.
Medical knowledge evolves continuously. While reasonable care is taken to ensure the accuracy of information on this site, to the fullest extent permitted by law the material is provided without any guarantees, conditions, or warranties as to its correctness, accuracy, reliability, or usefulness. Sycamore Healthworks Ltd does not accept responsibility or legal liability for any errors or for any misuse or misapplication of the material.
8. Limitation of liability
Sycamore Healthworks Ltd shall not be liable to users of this site by reason of any representation, implied warranty, condition, or other term, or any duty at common law or under the express terms of the contract, for any loss of profit or any indirect, special, or consequential loss, damage, costs, expenses, or other claims of any kind (whether caused by the negligence of Sycamore Healthworks Ltd, its servants or agents or otherwise) arising out of or in connection with the use of this website, except as expressly provided in these conditions.
Sycamore Healthworks Ltd shall not be liable to users or be deemed in breach of contract by reason of any delay in or failure to perform any of its obligations in relation to the website if the cause was beyond the reasonable control of Sycamore Healthworks Ltd.
In no event shall Sycamore Healthworks Ltd's total liability to any user for all damages, losses, and other causes of action (whether in contract or otherwise) exceed the total amount paid by that user to Sycamore Healthworks Ltd for use of the service.
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded.
9. Data and privacy
Sycamore Healthworks Ltd processes your personal data (including your registered email address, account password, and revision progress) in order to operate the subscription service and to deliver the contracted product. The lawful basis for processing is performance of contract (UK GDPR Article 6(1)(b)). Payment data is processed by Stripe and is not stored by Sycamore Healthworks Ltd directly.
For any data-subject request (including requests to access, rectify, or erase your personal data) please email support@echomcq.com. A full privacy notice is in preparation and will be published on this website in due course.
10. Changes to these terms
We may revise these Terms and Conditions from time to time. The version applicable to your subscription is the version that was current when your subscription started. Material changes will be communicated to active subscribers by email and posted on this page. Your continued use of the service after a material change has been communicated constitutes acceptance of the revised terms.
11. Governing law and jurisdiction
These Terms and Conditions shall be construed and governed exclusively by the laws of Scotland and, where applicable, by the wider laws of the United Kingdom. The Scottish courts shall have non-exclusive jurisdiction over any dispute arising out of or in connection with these terms; however, Sycamore Healthworks Ltd reserves the right to bring proceedings for a breach of these Terms and Conditions in any relevant country.
These Terms and Conditions do not otherwise affect your statutory rights as a consumer.
